CONCILIA'S FOUNDER HELD A WORKSHOP FOR dETECON ASIA-pacific lTD. AND THE NATIONAL BROADCASTING AND TELECOMMUNICATIONS COMMISSION OF THAILAND.
3 July 2013 at the prestigious meeting room of the Hotel delle Nazioni, Rome, Italy, the Founder of CONCILIA, Avv. Alessandro Bruni JD, met experts from Detecon Asia-Pacific Ltd., a Division of Deutsche Telekom, and Officers from the National Broadcasting and Telecommunications Commission of Thailand (NBTC).
Detecon Ltd. is one of the world's leading consultancies in the field of information and communication technology, with more than 1000 people in 15 locations around the world. Their international line-up has executed projects in more than 160 countries.
The workshop with CONCILIA was part of a project regarding the study of Alternative Dispute Resolution (ADR) in telecommunication industry. The project aimed to study and analyze the best practice of Complaint Handling and ADR processes, especially the dispute between service providers and consumers.
The workshop held by Alessandro Bruni dealt with the following topics
- ADR system in Italy, especially with a focus on Telecommunications disputes;
- consumer’s disputes in Italy and the relationships with the Italian Associations of consumers;
- the mediation training system in Italy, and the control done by the Ministry of Justice on mediators and providers;
- the market of CONCILIA all over Italy and abroad;
- possibilities of cooperation between Detecon Asia-Pacific Ltd., the National Broadcasting and Telecommunication Commission of Thailand and CONCILIA in order to organize ADR activities together, like trainings for mediators and supporting the dissemination and the creation of awareness in mediation, etc....

For the public sector Detecon Asia Pacific Ltd and NBTC arranged a visit to AGCOM, the Italian Telecom Regulator.
Detecon Ltd. is one of the world's leading consultancies in the field of information and communication technology, with more than 1000 people in 15 locations around the world. Their international line-up has executed projects in more than 160 countries.
The workshop with CONCILIA was part of a project regarding the study of Alternative Dispute Resolution (ADR) in telecommunication industry. The project aimed to study and analyze the best practice of Complaint Handling and ADR processes, especially the dispute between service providers and consumers.
The workshop held by Alessandro Bruni dealt with the following topics
- ADR system in Italy, especially with a focus on Telecommunications disputes;
- consumer’s disputes in Italy and the relationships with the Italian Associations of consumers;
- the mediation training system in Italy, and the control done by the Ministry of Justice on mediators and providers;
- the market of CONCILIA all over Italy and abroad;
- possibilities of cooperation between Detecon Asia-Pacific Ltd., the National Broadcasting and Telecommunication Commission of Thailand and CONCILIA in order to organize ADR activities together, like trainings for mediators and supporting the dissemination and the creation of awareness in mediation, etc....

- The Acting Executive Director, the Division Director, the Senior Legal Officer and the Mediation Analyst Officer of the National Broadcasting and Telecommunication Commission of Thailand;
- Two Client Partners at Detecon Asia-Pacific Ltd.
CONCILIA was the sole Italian private ADR Provider choosen by Detecon and NBTC for getting informations, for being trained in mediation techniques and to learning about the ADR system in Italy.

The draftsperson of European law on mediation in civil and commercial
matters, Euro MP, Arlene McCarthy this week welcomed moves by the Italian Government to tackle notoriously long delays in the Italian legal system by adopting new rules on mediation as a quick, effective and cost effective alternative to civil litigation.
Labour’s Spokesperson on Legal Affairs Euro MP, Arlene McCarthy said: “In April 2008 the European Parliament voted to adopt new rules on mediation. In 2011 I drafted the Parliament’s report looking at how the new law was working across the European Union.”
“In 2011 Italy was already ahead of the game and being looked at as a
possible EU model of best practice on mediation. These new Italian rules
introduce a smarter form of mandatory mediation, asking litigants to start a mediation process, but allowing them to withdraw from the process at the beginning of the mediation for a nominal cost, if they think that the conditions for settling are not there.”
“This ‘opt-out’ system, giving litigants an actual mediation experience, should prove more effective than traditional “opt-in” approaches. The new law also includes ‘mandatory mediation information meetings’, as a pre-condition to trial.”
On the benefits of mediation Arlene added: “For individuals or businesses going to court is often a long, drawn out and costly affair. Mediation can be a flexible, speedy and cost-effective alternative solution.”
“In the UK alone litigation worth 200,000 Euros takes around 333 days to solve via the courts, and costs an average of 51,000 Euros. In contrast, mediation would take around 87 days and cost only a fraction of the price, at roughly 9,000 Euros.”
“The EU needs to learn from this new Italian model and do more to encourage and promote mediation as an alternative to legal proceedings. It’s better for individuals and for business.”

A step forward for EU consumers: Commissioner Tonio Borg welcomes adoption of Out-of-court Dispute Resolution
Commissioner for Health and Consumer Policy, Tonio Borg, welcomed the vote of the European Parliament on Alternative Dispute Resolution and Online Dispute Resolution (ADR-ODR) today. This vote confirms the agreement on the two proposals put forward by the European Commission in 2011.
Tonio Borg said: "Today, the European Parliament confirmed its agreement on two key proposals for boosting growth in the Single Market and strengthening the Digital economy. ADR and ODR are a win-win for consumers, who will be able to resolve their disputes out-of-court in a simple, fast and low-cost manner, and also for traders who will be able to keep good relations with customers and avoid litigation costs.
It must be stressed that the EU institutions achieved a fast agreement which will significantly improve everyday life for consumers across Europe".
He also added: "I want to take this opportunity to thank the rapporteurs of the two proposals at the European Parliament, Louis Grech and Róża Thun, for their commitment to reach an agreement. I am also grateful to the Member States and the Presidencies of the Council for their intensive work on these files. This is a truly inter-institutional achievement to boost consumers' and traders' confidence in the internal market and its digital dimension."
The rules on ADR will ensure that consumers can turn to quality alternative dispute resolution entitiesfor all kinds of contractual disputes that they have with traders; no matter what they purchased[1] and whether they purchased it online or offline, domestically or across borders.
According to the ODR Regulation, an EU-wide online platform will be set up for handling consumer disputes that arise from online transactions. The platform will link all the national alternative dispute resolution entities and operate in all official EU languages.
Raising consumers' awareness is another pillar of this legislation, as traders will need to provide consumers
with adequate information on ADR and ODR.
Member States will have two years to implement the ADR/ODR rules. The ODR platform will be operational at the end of 2015.

24/10/2012, The Constitutional Court decided: the compulsory mediation is unconstitutional.
The Italian Constitutional Court has declared the Legislative Decree no. 28 of March 4, 2010, unconstitutional, for excess of delegation ("eccesso di delega"), in the part in which it provides for a compulsory mediation (Article 5, paragraph 1).

23TH OCTOBER 2012: THE DESTINY OF MEDIATION IN ITALY IS LINKED TO THE DECISION OF THE CONSTITUTIONAL COURT OF TODAY.
The decision of the Italian Constitutional Court on the Civil Mediation is expected this afternoon.
The session got underway at 10:30 a.m. morning, with the explanatory memorandum of the judge Criscuolo. They then took the floor, in order, UNIONCHAMBERS and THE Chambers of Commerce in favor of the compulsory nature of the Civil Mediation, then the Unitarian Lawyers' Body (OUA), which instead expressed its opposition to the compulsory nature itself.
In his conclusions, the admitted parties' lawyers reiterated their respective positions.
At 12:20 a.m. the public hearing was closed.
As it is known, the question concerning the constitutionality of Art. 5, paragraph 1, and Article. 16, paragraph 1, of Legislative Decree no. 28 of 2010 had been raised by the Lazio Regional Administrative Court, by order of 12 April 2011.
In essence, the key issues on which the Court is asked to rule are: (1) the obligatory mediation attempt in the subjects in art. 5, paragraph 1 of Legislative Decree No. 28 of 2010 (any excess of delegation with respect to the provisions of art. 60 of Law No. 69 of 2009 and compliance with Community rules laid down in Directive 52/2008 that does not impose an obligation of mediation attempt, although not excluding it), and the alleged excessive burden of the costs of mediation, which would be likely to impede access to justice (guaranteed to all by article 24 of the Italian Constitution).
For the above mentioned reasons, therefore, we have to wait.
